Himalaya Sport Inc. is an independent retailer of branded sporting goods. Unless otherwise stated, products sold on this website are not manufactured by Himalaya Sport Inc. Products may be sourced through direct brand relationships, authorized distributors, or specialized commercial partners, depending on the brand and product category.

Some Nike products sold through our stores are sourced through Athlete Performance Solutions, an authorized global licensee of Nike Inc. We maintain sourcing and purchase documentation to support product authenticity and traceability.

5. Pricing, Taxes and Promotions

5.1 Pricing and Taxes

• All prices are displayed in U.S. Dollars (USD) unless otherwise stated.
• Prices do not include applicable sales tax, which will be calculated and added at checkout in accordance with state and local tax regulations based on the shipping address.
• The strikethrough price shown next to the selling price is the manufacturer's suggested retail price ("MSRP"). Percentage savings shown on the website are calculated against this MSRP.
• We reserve the right to correct pricing or typographical errors at any time, including after an order has been placed.

5.2 Promotions Without a Promo Code

From time to time, we run promotional events (including Black Friday, Cyber Monday, Holiday sales and seasonal sales) during which discounts apply automatically to selected products, with no promo code required.

Duration: each promotion is valid for the period stated on the promotion page or in the communication announcing it, until 11:59 PM Central Time (CT) on the last day.

Eligible products: only products whose product page displays a discounted price during the promotion are eligible. Unless otherwise stated, new arrivals, gift cards, certain partner offers and certain best-selling classics are excluded; these products do not display a discounted price.

"Up to" savings: "up to X% off" refers to the highest saving off MSRP among the products included in the promotion; the saving for each product is shown on its product page.

Availability and combining offers: promotions are valid while supplies last. They can be combined with a promo code only if the terms of that promo code allow it.

5.3 Promo Codes

Some offers require a promo code to be entered at checkout. The specific terms of each code (validity period, discount amount or percentage, minimum purchase, eligible products, combinability) are stated on the "Promo codes" page of the website and in the communication announcing the code.

Unless otherwise stated, promo codes are single-use, non-transferable, have no cash value and cannot be combined with other promo codes. We reserve the right to cancel any discount or order in the event of abusive or fraudulent use of a code, or if its terms are not met.

6. Orders and Payment

• An order is considered accepted only after payment authorization and the issuance of an order confirmation email.
• Accepted payment methods are displayed at checkout. All payments are processed through secure third-party payment providers.
• We reserve the right to cancel or suspend any order in cases of payment failure, suspected fraud, or violation of these Terms.

• Delivery times are estimates only and are not guaranteed. Delays may occur due to carrier constraints, weather conditions, or other factors beyond our control.
• Risk of loss and title to products pass to the customer upon delivery of the order to the carrier.

8. Returns and Exchanges

We aim to maintain a fair and transparent return policy consistent with U.S. specialty retail standards.

Unless otherwise specified:

• Return requests must be initiated within 30 days of delivery
• Items must be unused, unworn, and in original condition
• Original packaging and tags must be included
• Refunds are issued to the original payment method after inspection of the returned items.
• Shipping charges are non-refundable unless the return results from an error on our part.
• Certain items, including clearance items, personalized products, or worn footwear, may be non-returnable.

9. Fit, Performance, and Use Disclaimer

• Athletic products are subject to individual fit, training conditions, and usage.
• Customers are responsible for selecting products appropriate to their activity and level. Himalaya Sport Inc. shall not be liable for injuries, discomfort, or performance issues arising from product use.

• To the fullest extent permitted by law, Himalaya Sport Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of this website or our products.
• Our total liability shall not exceed the amount paid by the customer for the product giving rise to the claim.
